Early this year, he had his file transferred from Makindye General Court Martial (GCM) to civilian Courts following the order of Supreme outlawing the trial of Civilians in Army Courts through its ruling delivered on 31st January in a matter filed by Hon. Michael Kabaziguruka Vs Attorney General.

Agaba, through his lawyers applied to be released on mandatory bail, having clocked over 290 days on remand without being tried.

Although the applicant’s (Bobi Young) lawyers had formally applied for bail, they appeared physically with their client in court ready to hear the response of the State Prosecution (respondents), only to be told that they are not yet ready and thus asked for more time.

The judge has issued a timeline , where, the state will be filing their rejoinder in reply on Friday, on Monday 18th August, the applicants will be filing their final rejoinder and then he will deliver the ruling on 22nd August 2025

“We are hopeful that our brother will be released, it’s mandatory in nature that if an accused is on remand before committed for trial to High Court for more than 180 days, it’s a constitutional demand that such a person must be released immediately. After the decision of Supreme Court he has been on remand for 191 days.” Remarked counsel Samuel Muyizzi on addressing the press at High Court in Kampala immediately after court

The lawyers expressed disatisfaction with the judge’s holding the hearing of such a matter of public importance in Chambers which denied many people a chance to participate in the hearing.

Bobi Young’s team of more than eight lawyers had Hon. shamim Malende (Kampala Woman MP), Lena Zedriga Deputy President National Unity Platform for Northern Region and many others.
