Buried in the sand! Judge declines to hear Bobi Wine case in Mbale, adjourns it until COVID-19 is over

In a surprising twist of events, Mable High Court Magistrate has declined to hear a case in which Bobi Wine through his lawyers; Wameli and Co. Advocates sued the Inspector General of Police IGP Okoth Ochola alongside Mbale RDC for blocking his radio talk show at Mbale based BCU FM.

The determined judge adjourned the matter sine die, ostensibly until the COVID-19 situation normalises.

Bobi Wine legal team objected to this because firstly, this is a human rights case which must be heard and determined expeditiously.

Judge said that he couldn’t proceed with case, because court had been filled to capacity by National Unity Platform supporters but despite the same same court conducting hearings with even more people in there.

“In fact, only 10 minutes later, in the same courtroom, another matter came up and the Magistrate heard it in the same chambers with the same number of people present,” Bobi Wine who travelled throughout the night to attend court in Mbale wrote immediately after his case was buried in the sand.

Police had deployed heavily and prevented us from accessing court the presidential candidate for several hours until the people gathered in multitudes.

As soon as a few of his team were let in, teargas and live bullets were fired to disperse his supporter—sparking off running battles where several people have been arrested and others injured.

Bobi Wine said he’s going to invoke some administrative remedies to see that justice is served in this matter.

He also put President Museveni and his men on notice, warning to be reminded that Ugandan courts are not the alpha and omega.

“That is why we are in advanced stages of ensuring that these cases are also heard by international courts and tribunals”.
