Court stays criminal proceedings against City lawyer

KAMPALA– High court judge Isaac Muwata has ordered Buganda Road Chief Magistrates Court to stay the trial of city lawyer Kintu Felix Nteza on charges of obtaining money by false pretense.

Kintu had earlier on petitioned High Court Criminal Division challenging being tried into Courts (Buganda Road and High court civil Division) on the same matter at once.

In his ruling , Justice Muwata noted that court observed that allowing a case with similar facts to proceed in two similar courts will be a total abuse of the court process.

The trial judge also observed that staying the trial at Buganda road would not in any way interfere with the case or powers of the Prosecution since they still have Powers to resume hearing of the same case once the matter in High court is fully heard and disposed off.

Upon receiving the court decision , Kintu welcomed this decision which he described as a long awaited just decision which has a great impact into his life.

“The most important thing , I was a lawyer in this case , I was working for some my clients who are well known. This was a matter of breach of Contract and turning it into a criminal matter is so unfair.” Kintu added

In the case before Buganda Road Chiwf Magistrates court , Kintu Nteza is charged with obtaining money amounting to 195 million shillings by false pretense from E Link Educational services pretending that the administrators of the estate of the late Kamya George and the beneficiaries of the said estate to wit land comprised in Busiro Block 220 Plot 64 Land at Gimbo, Wakiso District were selling to Interlink Education Services Iimited.

By the time of this Judgement, this matter has been at a hearing stage before Buganda Road Grade one Magistrate Fedelis Otwao.
