Ex-UPDF Soldier Sentenced to 45 years in jail Over Defilement

Arua- In a noble affirmation of the rule of law and the protection of children, the Office of the Director of Public Prosecutions (ODPP) has successfully prosecuted a former UPDF soldier, Anguzu Andrew (AA) for defiling a 13-year old girl, and the High Court sitting in Arua has sentenced him to 45 years’ imprisonment.

The judgment delivered by the Hon. Justice Vincent Wagona on Monday resulted from a carefully investigated and professionally prosecuted case that shows the decisive role of investigation and prosecution in advancing criminal justice and protecting the most vulnerable members of society.

Evidence presented by the ODPP before court revealed that AA was formerly a soldier of the Uganda People’s Defence Force (UPDF) whose military service ended in 2017. Following his discharge from the army, he returned to his village where he later married the grandmother of the victim, thus placing himself within the family circle of the young girl.

What should have been a position of guardianship instead became an opportunity for a calculated betrayal of trust.

The victim, SL., was only 13 years old at the time of the offence and a grandchild to AA’s wife.

AA went to the home where SL was staying with her aunt and falsely informed her that her grandmother required her presence. Trusting the adult, the child accompanied him. Instead of taking her to the grandmother, AA led her to his own home.

Once inside, AA closed the door and forcefully sexually assaulted SL, inflicting severe injuries. After committing the act, he abandoned the child, leaving her to make her way back to her aunt’s home alone.

The offence was further aggravated by the fact that the accused knew he was HIV positive at the time of the attack.

Fortunately, subsequent medical examinations confirmed that the child did not contract the virus.

Behind this conviction lies the meticulous work of investigators who promptly documented the crime, secured medical evidence, and gathered witness testimony that reconstructed the events leading to the offence.

The case was ably prosecuted by Mr. Muhereza Richard, Chief State Attorney, who also doubles as the Regional Officer of ODPP Arua.

Through rigorous case preparation, sound legal strategy, and effective presentation of evidence, the prosecution ensured that the court fully appreciated the gravity of the offence, the abuse of familial trust, and the reckless exposure of a child to a life threatening disease.

In fulfilling its constitutional mandate, the ODPP continues to play a central role in upholding the rule of law, protecting vulnerable victims, and ensuring that those who commit serious crimes are brought to justice.

After evaluating the evidence and the circumstances surrounding the offence, the High Court convicted AA and imposed a 45-year custodial sentence.

It is clear from the sentence meted by Court that sexual violence against children will attract severe consequences, and that the criminal justice system will not hesitate to hold offenders accountable.
