Kiwanuka Galiko set to Appeal against Justice Kinobe’s Ruling

KAMPALA– Benedicto Kiwanuka Galiko, one of the Democratic Party members behind court cases aimed to bring the Party leadership into check, has finalized plans to appeal , the recent decision of High court judge Simon Peter Kinobe which dismissed his case accusing Hon Nobert Mao Courtesy of Contempt of Court.

In the other case which was first had by Justice Douglas Singiza before being transferred to Judicial service commission, was that Galiko filed Miscellaneous Cause No. 306 of 2020 challenging the legality of the electoral process of the members of NEC of the Democratic Party , the matter was heard and judgment delivered, and he later filed another application claiming the respondents in this matter , Mao and the group , were in contempt of court and thus seeker for orders pending its determination.

On dismissing the application, Kinobe noted that the application had already been overtaken by events and there was no status quo to maintain.

“The orders were specific to an event and a bar to a repeat of similar infractions and not a bar to future elections of the 1st respondent. I therefore find that this application does not fulfill this cardinal requirement for the grant of a temporary injunction as there is no status quo to maintain.”

Being dissatisfied with the above reasons Galiko filed a notice of Appeal expressing interest to appeal.

On addressing the press, he revealed that he had finalized the whole process and he is ready to file his appeal.

“The law can’t be set with a view of punishing one person, how come that all other judges have been allowed to finish their cases, but on mine when Justice Singiza was transferred, it was just given to another officer to finalize it. Its unfortunate that the judge didn’t even get an opportunity to hear the matter.”

He also pointed out that the matter which were put in the judgement, were not those that he had raised in his application.

Galiko also has other reasons he fronted in his appeal that he seeks the panel of justices to look into.
