KAMPALA -Jakana Limited and Herbert Daniel Jakana have expressed interest to appeal the decision of High Court Judge Alice Komuhangi Khaukha in which she issued guidelines on how to manage the property of the late Daniel Nelson Nkuse Jakana.

In her ruling, the trial judge, declared that land comprised on Block 273 Plot 2694 LRV 726 Folio 17, at Upper Konge and currently registered in the name of Jakana Ltd (suit land) is one
and the same land (kibanja) that was mentioned in Clause 18 of the Will of the late Daniel Nelson Nkuse Jakana and therefore, forms part of the estate of the late Daniel Nelson Nkuse Jakana.
“The Commissioner Land Registration is hereby directed to vacate the caveat lodged on the Certificate of Title of the suit land by Beatrice Kagga Nnalongo Mwagale and cancel the Certificate of Title in the name of Jakana Limited with immediate effect; The suit land reverts to the estate of the late Daniel Nelson George Nkuse Jakana.” Court ruled
Court went ahead and stated that the Letters of Probate granted to Daniel Herbert Lule Jakana and Edith Naguja Jakana were obtained fraudulently and therefore invalid but they have since expired, and the same shall not be renewed.
Since, Jakana Limited and Herbert Daniel Jakana didn’t agree with the above court decision and being that the law grants them an opportunity to appeal the decision within 14 days, they have formally filed a notice of appeal before the Court of Appeal in Kampala.
“Being dissatisfied with the decision and Judgment of the Honorable Lady Justice Alice Komuhangi Khaukha, that she delivered on the 25th day of July 2025, the Ist and 2nd Defendants have instructed us to appeal against it in its entirety to the Court of Appeal.” Reads the Notice
The Notice of Appeal authored by Kirunda and Company Advocates, has been served to Matrix Advocates as well as Jambo and Company Advocates.
