
KAMPALA– Benedicto Kiwanuka Galiko , the Democratic Party (DP) member, popularly known for filing a number of cases in several courts of law opposing the party leadership, has threatened to petition Principal judge over irregularities.
This has followed Galiko’s failure to secure the records of proceedings to support him in filing his appeal in a case against the current Democratic Party leadership which was recently dismissed by High court Judge Simon Peter Kinobe with orders to pay costs.
“The judge delivered a judgement in this case without hearing it as required by law. I asked Court for the records of proceedings and other accompanying documents, but all they have been doing has been to toss me around.”
He pointed out that the last time he requested for the proceedings , he was provided with those of other cases yet the matter was heard in an open court.
” On 27/6/2024 the matter was heard by Dr. Douglas Singiza at 10 am in an open court, I shown them a hearing notice signed by His worship Simon Kintu Zirintuusa. I asked them if you don’t see the information retrieve the audios.”
Galiko stated that heading to appeal without the records, it will give the court of Appeal a lee way to confirm the decision of the lower court because there will be no evidence to re evaluate.
“I have already told the Registry staff, that if your don’t have the records and other accompanying documents, then I write to Principal Judge for the way forward.”
In the matter which was dismissed by Court, Galiko that it was illegal for Dr. Gerald Siranda (Secretary General), Mayambala Kiwanuka (national Chairman), Hon. Nobert Mao (President General) and Herbert Rutagwera (organizing Secretary) , to continue holding Party offices after Gulu High court ruling which declared that they were not legally elected.
That their continued stay in office was an act of contempt of Court.
