Doctor Testifies in Kayanja Sodomy Case

MENGO– Dr. Kalungi Sam , a medical practitioner who heads Pathology Department at Mulago Hospital, has been the sixth prosecution witness to testify in a case where ten people are accused of falsely accusing Pastor Robert Kayanja of sodmizing them.

Some of thw accused persons in court early this month.

On appearing before Mwanga II Grade one Magistrate Adams Byaruhanga, the Doctor has informed court that he conducted medical examination on all the accused persons on the request of various investigative officers from Police.

“At first, I examined Serugo upon the request by Detective Inspector of Police Nandutu Cotilda. Serugo alleged that he was arrested in 2021 as he went to Miracle Center Cathedral Rubaga where he had gone to pick his money which had been promised to him after being sodomized.”

Dr. Kalungi revealed that received Serugo in a fair condition, he was normal with both his ears pierced.

“Both buttocks and the anus were in normal condition, no ulcer, no wounds and no bleeding. The clothes had no stains of feaces.”

He added that he also examined the rest of the accused persons who claimed to have been arrested in the same manner but his findings were that , they were all under normal mental status, well oriented, no signs of bleeding on the anus and the sphincter muscles were all intact.

“The examination was important because when a person has been sodomized , the muscle can’t hold human waste , it just passes out.” He added

The examination was conducted in September 2021 and he signed against all forms that contained his findings.

All these forms have been tendered in court as Prosecution exhibits having been identified and owned by the author himself.

Earlier on, the Defense had asked court not to allow these exhibits on grounds that the person who conducted the medical examination was a medical doctor yet the request was made to a Police Surgeon.

The State Prosecution led by Jonathan Muwaganya responded that the request had no specific individuals tasked to do so and the practice allows any medical officer to do so once he operates in that area where Police has no assigned surgeon.

The Magistrate ruled in favor of the Prosecution and allowed the exhibits on record.

The Prosecution has also presented a seventh witness identified as Kisakye Collins a former guard at Pastor Kayanja’s place who narrated how he trained and ended up as a security guard.

Due to time factor, his testimony has not been concluded after the Magistrate adjourned the matter to 7th February 2023 for further hearing and cross examination.

The accused in this matter are: Wasswa Israel, Peter Serugo, Reagan Ssentongo, Moses Semanobe, Khalifa Labeeb, Henry Lyaz, Alex Wakamala, Martins Kagolo,Jamil Mawanda and Aggrey Kanene.

Prosecution contends that on September 17,- 2021, the accused persons and others still at large in Kampala district conspired together to falsely accuse Pastor Robert Kayanja of unnatural offences.

Its further alleged that the same individuals in the same period with others still at large on or about in Kampala district conspired together to commit a felony, to wit, Conspiracy to defeat justice.
