Court to decide on Land dealer Kamoga’s criminal trial

KAMPALA -High Court Judge Isaac Muwata has set the 21st November 2023 as the date on which he will deliver a ruling in a case where reknown land dealer Muhamad Kamoga challenges being tried in Entebbe Magistrates court on land fraud charges.

Kamoga petitioned High court challenging his trial on grounds that the cases in lower court can’t proceed when there is two cases in both High and Court of Appeal resulting from the same matter.

He therefore asked to issue an order halting the trial before Magistrates court untill the Cases in superior courts are fully heard and disposed off.

In the Criminal Case against Kamoga before Entebbe Magistrates Court , a one Peter Babingamba acusses the business man bleach of contract when he failed to process land titles for people seated on his 200 acres of land located in Bukaaya – Katabi Town Council in Entebbe Municipality ,but instead resorted to forge them.

On commenting on the matter immediately after court, Kamoga expressed gratitude to the Judiciary of having given him a chance tod hear his case in a timely manner.

“I did the job as expected in a timely manner , am worried that the Land lord was misled by some individuals with selfish interests and thus dragged me to court.”

The respondent’s lawyer asked Kamoga that if he thinks that he is wise (innocent) , why is dodging being tried in court.

“This matter is about one individual who wants to escape trial by alleging that the trial Court in Entebbe , has no jurisdiction to hear the matter

The lawyer also exhbited confidence in the judiciary with hope that any time from now , his clients will be served with justice.

Harriet Nabyonga one of the residents on the side land asked court to decide the mattee with fairness because they have suffered enough.

More about the case

In the case before Entebbe Chief Magistrates Court,last month Kamoga was charged with forgery and uttering a false document and obtaining registration by false pretence.

The Prosecution contends that on May 7, 2021, at Wakiso Lands Office, Kamoga with intent to deceive, forged a transfer fromĀ  dated May 7 concerning land on block 435 plot 8 purporting it to have been by Bibangamba Peter whereas not.

It is further alleged that Kamoga willfully procured for himself the registration of disputed land under the Registration of Titles Act by pretending that the same was transferred to him by Bibangamba.

These charges came as a result of complaints regarding four plots on land loacted on Block 435 at Bukaaya Village in Katabi Town Council, Entebbe where

Bibangamba is accusing Kamoga of subdividing his land into more than 1O0 plots and transferring them into his name and later on selling them off without his consent.
