Master Electronics petition Principal Judge over ‘unfair’ court Proceedings

KAMPALA -MP Electronics and New Master Electronics through their lawyers of Muwema and Company Advocates have petitioned the Principal Judge Dr. Flavian Zeija , seeking his intervention in what they have referred to as injustice meted to them by a High court judge Stephen Mubiru in this matter.

In the letter dated  February 1st 2024, with receipt acknowledgement stamp from the office of the Principal judge dated  February 2nd 2023, the complainant companies contend that they are at a verge of losing two of their prime properties to DFCU bank over a loan that they have never acquired.

“Our clients are perplexed that the High Court has consistently refused to accord them their non-derrogable constitutional right to be heard with regard to the unproved disbursement and utilization of the alleged loan. Moreover previous applications to inspect the banker’s books to establish the disbursement, withdrawal and utilization of the alleged loans by our clients have not been heard and remain ignored by the Court.” reads part of the letter

They added that the disputed loan in question amounts to USD3.8 million plus Ushs.3 billion and is the subject of impugned credit facility Agreements issued in 2014.

That the said sums were never credited and/or disbursed to our clients’ account and there is no evidence to the contrary which has been adduced by DFCU Bank to date.

“The High Court has selectively relied on technicalities to bar our clients from being heard on the substance of this dispute which has in the process facilitated DFCU Bank to unlawfully sell /transfer our client’s above mentioned properties. It should be noted that our clients have so far resisted the unlawful take over of their properties by 3rd parties who claim to have “purchased”.

The Advocates also contended that the High Court has selectively relied on technicalities to bar our clients from being heard on the substance of this dispute which has in the process facilitated DFCU Bank to unlawfully sell /transfer their client’s above mentioned properties.

“Whereas our client has struggled to remain in possession of its Properties, DFCU Bank is continuing to manipulate the High Court process to illegally gain vacant possession and unjustly enrich itself in a case where it did not disburse any funds.”

Its from the above grounds that they have requested for your Principal Judge’s intervention as head of the High Court to call for and examine the said file so that the ends of Justice can be served by enabling a proper inter parties hearing before another judge.
